Under the Wyoming Durable Power of Attorney Act, Title 3 > Chapter 5, allows for a resident to fill in a document to grant someone else, an ‘Agent’, the full power to act in the presence for any type of financial matter including;
- Collect and manage personal property
- Buy and sell real property
- Borrow money
- Handle business and banking transactions
- File tax returns and reports
- Access to safe deposit boxes
- Proxy rights to stocks, bonds, shares, and other investments
- Legal and administrative proceedings
- Transfers in trust
- Delegation of authority to engage and dismiss agents, counsel, and employees
The form’s most important aspect is it’s durable functionality, meaning it remains in effect if the principal may no longer be able to think for themselves. In order for the document to take effect, it must be completed and signed with all the parties of the form present in front of two (2) adult witnesses or a notary public.
