Durable power of attorney is a designation created by a resident of West Virginia to designate someone else to have the ultimate rights to handle every facet of their financial capabilities. Under the Uniform Power of Attorney Act, the document remains in effect if the principal should become incapacitated, meaning to lose the ability to think for themselves.
There are strict rules upon authorizing the document in West Virginia. Under Statute 39B-1-105, the document is required to be signed in the presence of a notary public.
