The person doing the representation, the ‘Agent’, must always perform all acts in the best interests and to the favor of the person being represented, the ‘Principal’.
The principal may choose the exact actions by selecting from the list of options on the form or by writing in themselves. The period for which the form will be valid, may be for;
- A period of time
- During any incarceration or deportation of the principal
- At the time the objective is complete
- Or at any other specific guidance made by the principal
There are two types of limited power of attorney forms to choose from;
- Durable – Remains in effect if the principal becomes incapacitated
- Non-Durable – Does not remain in effect if the principal should become incapacitated
