Using this form, the principal should be understand that the form stays valid if you become mentally incapacitated. Meaning if something were to happen to you, your agent would know what decisions to make for you in case this happens. This form allows your agent to hold all decision making powers on your behalf.
- Under State law, the durable form may be signed and powers granted as long as;
- (a) Sufficient knowledge of the principal to demonstrate interest in the welfare of the principal; and
- (b) The lack of capacity of the principal to bring such a petition.
