The Indiana Financial Power of Attorney has two options, you can choose to have it go into effect immediately, known as “durable”, or have it start when your physician declares you to be incapacitated known as ‘springing’. In Illinois, there is no restriction as to whom you can appoint as your Attorney-In-Fact, but it is important to choose a solid, trustworthy individual who can grasp the scope of your business dealings and shares your financial beliefs.

It is a good idea to appoint someone who lives near you, so he or she can more easily carry out your business transactions face-to-face as needed. It’s also prudent to name an alternate Attorney-In-Fact in case your first choice turns out to be not available when needed. You can revoke this document at any time you choose to as long as you competent mentally to do so. If you appoint your spouse, the agreement terminates if you divorce.
