The “durable” functionality allows a person to still be able to make monetary transactions even if the principal should become in a state of mental incapacity. The document must be authorized with at least two (2) witnesses although it is highly recommended that it be done with a notary public.
The form may only be cancelled if;
- A new durable power of attorney document is created
- A revocation form is authorized
- Death of the principal – All assets will be immediately transferred to the estate and the document will become void
