The Texas durable financial power of attorney document, also known as the ‘Statutory’ form, for the State of Texas can be used for powers handed to another person for monetary reasons that are broad and sweeping. This particular financial document allows even for it’s financial use even if the principal should not be in a position to think for themselves.

The powers granted to the agent include (unless the principal restricts it’s use);

  • Real property transactions; 
  • Tangible personal property transactions; 
  • Stock and bond transactions; 
  • Commodity and option transactions; 
  • Banking and other financial institution transactions; 
  • Business operating transactions; 
  • Insurance and annuity transactions; 
  • Estate, trust, and other beneficiary transactions; 
  • Claims and litigation; 
  • Personal and family maintenance; 
  • Benefits from social security, Medicare, Medicaid, or other governmental programs or civil or military service; 
  • Retirement plan transactions; 
  • Tax matters.

The form must follow all State laws (Title 2, Chapter 752 – Statutory Durable Power of Attorney) and to become in effect should be signed with one of the following bearing witness;

  • Notary Public – Including acknowledgment and seal
  • Two (2) Witnesses
