The Missouri financial durable power of attorney document is used to allow a person (known as the ‘Attorney-in-Fact’) that you can trust “to act in your shoes” in all of your business relationships and assets. If you want he or she to take over at immediately, you must draft the document as a “Durable” Financial Power of Attorney, or you may choose to have it become void when you do become incapacitated, or “Springing”.
Most people choose their spouse or relative for this designation with keeping in mind that in Missouri, if you do choose your spouse, the agreement becomes void upon divorce. To make sure that there is an agent to act in your presence at all time it is a good idea to name a secondary agent.
